These Terms of Service govern your access to and use of the website at lmhbackyardbuzz.lol and the professional services provided by LMH BACKYARD BUZZ LLC. By visiting the website, submitting the contact form, booking a visit, or engaging our studio, you agree to these Terms. Please read them carefully, because they set out the ground rules for our relationship and describe what each side can expect.
LMH BACKYARD BUZZ LLC is a backyard observation hive studio and a computer integrated systems design practice based in Salt Lake City, Utah. We design pollinator habitat, install native bee housing, monitor hive health, maintain seasonal gardens, relocate swarms and run community workshops. These Terms apply to all of those activities and to anyone who uses our website.
1. Acceptance of These Terms
By accessing this website or engaging our services in any way, you confirm that you have read, understood and agreed to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the website or engage our services.
These Terms apply together with any written proposal, statement of work or service agreement that we provide for a specific project. Where a written project agreement conflicts with these Terms, the project agreement governs for that project. Nothing in these Terms limits any right that cannot be limited under applicable law.
We may ask you to confirm acceptance of these Terms in writing before beginning work. Where you proceed with a project after receiving these Terms or a proposal that references them, your conduct indicates acceptance.
2. Definitions
In these Terms, the Company, we, us and our mean LMH BACKYARD BUZZ LLC. Client and you mean the person or organization that engages our services or uses our website. Services means the pollinator habitat, monitoring, installation, care, relocation, workshop and related professional work described on this website. Website means the site located at lmhbackyardbuzz.lol and any subdomain or successor we operate. Content means text, images, designs, plans, data, ledgers, reports and other materials we create or provide.
References to a season mean the relevant spring, summer, autumn or winter working period for a project. References to a visit mean an on-site appointment at the client property. References to sensor data mean readings from hive monitoring equipment concerning temperature, humidity, weight and similar conditions.
3. Eligibility and Account-free Use
You must be at least eighteen years old and able to enter a binding contract to engage our services. If you engage us on behalf of a company, association or household, you confirm that you are authorized to do so and that the organization agrees to these Terms.
Our website does not require you to create an account, and we do not maintain user logins for general visitors. The contact form and email are the primary channels for reaching the studio. Because there are no accounts, there are no account credentials for you to keep safe on our site, though you remain responsible for the security of your own email and devices.
4. Our Services
We provide backyard pollinator habitat and hive monitoring services, including pollinator garden design, hive health monitoring systems, native bee habitat installation, seasonal garden care plans, swarm capture and relocation, and community pollinator workshops. The services are described in more detail on the website, and a specific scope is agreed for each project.
Living systems are variable. A garden, a colony of bees and a season of weather cannot be fully controlled, and our role is to design and care as skillfully as we can rather than to guarantee a particular biological outcome. We will describe what we intend to do and why, and we will act with reasonable care and professional judgment throughout.
We may decline a project, modify a scope, or recommend against a course of action where we believe it is unsafe, unlawful, impractical or outside our competence. We may also engage qualified third parties for specialist tasks where that serves the project.
5. Booking and Engagement
Engagement begins when we accept a request and confirm the scope, schedule and fees in writing. A first visit may be a paid or complimentary survey, depending on the arrangement we agree. A request submitted through the contact form is an enquiry, not a confirmed booking, until we reply and confirm.
We may require a deposit before reserving seasonal capacity, because our calendar fills quickly in spring and autumn. Where a deposit is required, we will state the amount and the terms clearly, including whether it is refundable. Once a booking is confirmed, the agreed scope and schedule become part of our contract with you.
You agree to provide accurate information about the property, the hives and any known hazards when booking, so that we can plan the work safely and correctly.
6. Client Responsibilities
A successful habitat project depends on cooperation. As the client, you agree to provide reasonable access to the property on agreed dates, to secure pets and remove hazards where we ask, to disclose known risks such as unstable structures or active stinging insects in unexpected locations, and to obtain any permission needed from a landlord, co-owner or homeowners association.
You agree to follow the care guidance we provide between visits, to tell us promptly about problems such as flooding, construction or pesticide use near the habitat, and to avoid applying treatments that would harm the pollinators we are working to support. Where a client action damages a habitat or a colony, the cost of remediation is the client responsibility.
You agree to communicate respectfully with our team. We reserve the right to end a project where a site is unsafe or where conduct makes the work impossible, in accordance with the termination section below.
7. Fees, Quotes and Payment
Fees for our services are set out in the proposal or statement of work for each project and are valid for the period stated in that document. A quote is based on the scope and conditions known at the time; if conditions differ materially on arrival, we will discuss any change before proceeding and will not add charges without your agreement.
Unless we agree otherwise, invoices are payable within the period stated on the invoice. We may charge reasonable interest on overdue amounts where permitted by law. Work may be paused where an account is significantly overdue. Deposits, where required, are applied to the project or retained as described in the proposal.
You are responsible for any taxes lawfully applicable to the services. Where a payment is disputed, please contact us promptly so that we can review the matter and reach a fair resolution.
8. Scheduling, Weather and Changes
Outdoor work depends on weather and the seasons. We may reschedule a visit because of rain, wind, extreme heat, unsafe conditions or the welfare of the bees. We will give you as much notice as we reasonably can and will find the next suitable date.
You may request a change of date, and we will accommodate it where our calendar allows. Changes requested with short notice may incur a reasonable fee to cover reserved time, and we will always explain any such fee before it applies. Recurring seasonal care visits are scheduled flexibly to suit the plants and the weather rather than a rigid clock.
9. Workshops and Community Events
Community pollinator workshops are held in real yards and community spaces. Registration may be required, and places are limited. Where a fee applies, it is stated at registration. We may photograph or record a workshop for our own records or promotional use; if you do not wish to appear, please tell us and we will respect your preference.
Participants attend at their own risk of ordinary outdoor hazards, and are expected to follow safety instructions around hives, tools and plants. Minors may attend only when accompanied by a responsible adult or as part of an organized group with appropriate supervision. Where a workshop is cancelled by us, we will offer a rescheduled date or a refund of any fee paid.
10. Swarm Capture and Relocation
Swarm capture and relocation services are provided with care, but they involve live insects and unpredictable conditions. We cannot guarantee that a swarm will remain accessible or that an established colony can be removed without structural work. Where bees are settled inside a wall or similar void, we will explain the available options, which may involve a contractor for building repair.
Our priority is the safe relocation of the colony and the safety of people and property. We may decline a job that cannot be performed safely, and we may recommend an alternative specialist where that is the better course. Any building repair, pest treatment or follow-up construction is outside our scope unless we agree otherwise in writing.
Where relocation is successful, ownership of the relocated colony passes with the arrangement we agree, and we may place the colony in a suitable hive or wild location.
11. Monitoring Services and Data
Hive health monitoring uses sensors to record conditions such as temperature, humidity and weight. We provide the readings as a service to help you understand and care for your colony. Sensor data is supplied as observed information, and we do not warrant that it is complete, uninterrupted or free from error.
Equipment supplied or installed by us remains subject to the terms of the specific arrangement. You agree to allow reasonable access for installation, maintenance and removal of sensors, and to avoid moving or damaging equipment without telling us. Where a monitoring service is discontinued, we will arrange removal or transfer of the equipment and discuss what happens to the associated data.
Ownership and permitted use of assembled ledgers and reports are addressed in the intellectual property section below.
12. Intellectual Property
All content on the website, including text, layout, graphics, the observation hive design motif and the studio identity, is owned by or licensed to LMH BACKYARD BUZZ LLC and is protected by applicable intellectual property law. You may view and use the website for your own lawful purposes, but you may not copy, reproduce, republish or redistribute our content for commercial purposes without our written permission.
For client projects, the specific planting plans, ledgers and reports that we produce for you are provided for your personal and property use. We retain ownership of our underlying methods, templates and design systems, and we may reuse general knowledge and non-confidential techniques in future work. Where a project produces a deliverable, we will state in the proposal whether it is assigned to you or licensed to you.
If you submit material to us, such as photographs or notes, you confirm that you have the right to share it and you grant us permission to use it for the purposes of the project and, where you agree, for general studio promotion.
13. Acceptable Website Use
You agree to use the website lawfully and respectfully. You may not attempt to gain unauthorized access to our systems, interfere with the site availability, upload malicious code, scrape content at scale, misrepresent your identity, or use the contact form to send spam, threats or unlawful material.
We may restrict or block access where we reasonably believe that the website is being misused or that security is at risk. We do not guarantee that the website will always be available, and we may update, suspend or discontinue any part of it at any time.
14. Third Party Materials and Links
The website may include links to third party sites, references to external resources, or materials provided by others. These are offered for convenience or interest only. We do not control third party sites and we are not responsible for their content, accuracy, availability or privacy practices.
Your dealings with any third party you reach through our website are solely between you and that third party. We encourage you to review the terms and privacy notices of any external site before relying on it or sharing information with it.
15. Disclaimers and Warranties
Our services are provided with reasonable skill and care. Except as expressly stated in a project agreement, the website and its content are provided on an as available basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the website will be error free or uninterrupted, that defects will be corrected, or that the information on it is complete or current at all times. Gardening, beekeeping and pollinator habitat work involve natural variability and uncertainty. We make no guarantee about the number of pollinators, the survival of a colony, the bloom of a plant, or any other biological or environmental result.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
16. Limitation of Liability
To the fullest extent permitted by law, LMH BACKYARD BUZZ LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or related to your use of the website or our services, whether based in contract, tort, negligence or any other theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the services will not exceed the total fees paid by you to us for the specific service giving rise to the claim. Where local law does not allow a particular limitation, that limitation will not apply to the extent it is prohibited.
Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence where such liability cannot lawfully be limited.
17. Indemnification
You agree to indemnify and hold harmless LMH BACKYARD BUZZ LLC, its owners, employees and contractors from any claims, losses, liabilities, damages, costs and reasonable legal fees arising from your breach of these Terms, your misuse of the website, your failure to disclose a known hazard, or your violation of any law or the rights of a third party.
This obligation survives the end of our relationship and applies only to the extent that a claim results from your conduct or your breach rather than from our own negligence or wrongdoing.
18. Suspension and Termination
You may end an engagement by giving us reasonable written notice. We may end an engagement or suspend the website where a client fails to pay, breaches these Terms, creates an unsafe environment, or where continuing would be unlawful or seriously detrimental to the welfare of the bees or the team.
When an engagement ends, you remain responsible for fees for work already performed and for authorized commitments already made. We will return or remove our equipment where appropriate and will discuss the handling of project data and deliverables. Provisions that by their nature should survive termination, such as intellectual property, liability limits and indemnity, will continue to apply.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to conflict of law principles. Subject to any mandatory consumer protection rules that apply where you live, the courts located in Salt Lake County, Utah will have jurisdiction over any dispute arising from these Terms or our services.
Before starting formal proceedings, we ask that you contact us so that we can try to resolve the matter directly and in good faith. Many concerns can be settled quickly through a conversation. If a dispute cannot be resolved informally, either party may pursue the remedies available under applicable law.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, our practices or the law. When we make a material change, we will revise the date at the top of the page and may provide a clearer notice on the website. The version in effect when you engage our services governs that engagement unless we agree otherwise in writing.
Your continued use of the website or our services after a change takes effect indicates acceptance of the updated Terms. If you do not agree with a change, please stop using the website and contact us to discuss any ongoing service arrangement.
21. Contact Information
If you have questions about these Terms, a proposal, or an ongoing project, please contact us. We are happy to explain anything in plain language.
